Bismarck N.D. - The North Dakota Ethics Commission would like to remind interested individuals the Ethics Commission will hold a public hearing to address proposed amendments to N.D. Admin. Code chapter 115-02-01 at 9:30 am on Tuesday, September 9, 2025, at 600 E Boulevard Ave, Judicial Wing Room 321, Bismarck, and on Microsoft Teams here.
The proposed amendments implement N.D. Const. art. XIV, § 3(2) and Senate Bill 2004 enacted during the most recent legislative session, concerning the complaint process, referrals of complaints to law enforcement, settlement of complaints with the Ethics Commission, motions to dismiss a complaint submitted by respondents, and complaint management time standards. The purpose of the proposed amendments is to implement the statutory amendments into the Ethics Commission’s rules and clarify the Ethics Commission’s process for receiving and processing complaints, summary dismissals, and final action on complaints. The proposed amendments set and clarify definitions for complaints, clarify the Ethics Commission’s jurisdiction and complaint limitation period, clarify how a complaint can be submitted and summarily dismissed, modify the standard for referrals of complaints to law enforcement, set how a respondent can submit a motion to dismiss, set how the Ethics Commission may settle a complaint, clarify the hearing process for final action on complaints, and set complaint management time standards.
